By accessing or using ClearSend's API, web interface, or network infrastructure ("Services"), you explicitly agree to be bound by these Terms of Service. ClearSend operates primarily on a data package and subscription model. Your access to the Services relies on maintaining an active, solvent account with appropriate data volume allocations.
We strive to maintain maximum uptime and routing efficiency. However, ClearSend interacts with inherently volatile external environments (third-party contact forms, CAPTCHAs, and firewalls).
Consequently, while we guarantee platform availability, we do not formally guarantee the successful submission rate to any specific target domain, as third-party modifications, strict blocking policies, or outages on the target's side are outside our sphere of control.
As a user of our infrastructure, you are strictly prohibited from utilizing ClearSend to route or deliver:
We reserve the right to immediately suspend or terminate accounts found to be in violation of our Acceptable Use Policy without refund.
In no event shall ClearSend, its directors, employees, or infrastructure partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services, including but not limited to loss of profits, data, or business reputation.
You are solely responsible for ensuring that the messages and campaigns you conduct via our infrastructure adhere to the anti-spam and telemarketing regulations relevant to your jurisdictions (e.g., CAN-SPAM).
